Terms of Service

These Terms of Service ("Terms") govern your access to and use of GrowDeck, an autonomous SEO platform operated by PandaStack ("we", "our", or "us"). By creating an account or using any part of GrowDeck you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use GrowDeck. By accepting these Terms you represent that you meet this requirement. If you are using GrowDeck on behalf of a company or organisation, you represent that you are authorised to bind that entity to these Terms.

2. Your account

You are responsible for maintaining the security of your account credentials. We are not liable for any loss or damage arising from unauthorised access to your account. Notify us immediately at [email protected] if you suspect unauthorised access.

You may not share your account with others or create accounts for the purpose of abusing free-tier limits. We reserve the right to suspend accounts that abuse the service.

3. Acceptable use

You agree not to use GrowDeck to:

• Crawl or generate content for websites you do not own or have permission to optimise.
• Publish content that is unlawful, defamatory, infringing, or deceptive.
• Generate spam, manipulate search rankings through link schemes, or violate Google's Webmaster Guidelines.
• Reverse-engineer, decompile, or extract the underlying source code of GrowDeck.
• Use automated scripts to access the GrowDeck API beyond documented rate limits.
• Resell or sublicense access to GrowDeck without our written consent.

4. Content you own

You retain full ownership of any content you provide to GrowDeck (including your website content, brand assets, and any content you approve for deployment). By using GrowDeck you grant us a limited, non-exclusive licence to process, store, and transmit that content solely to provide the service to you.

You are solely responsible for ensuring that any AI-generated content we produce on your behalf is reviewed before publication and complies with applicable laws and platform policies.

5. AI-generated content

GrowDeck uses large language models (including OpenAI GPT-4o) to generate landing page copy, metadata, and keyword analysis. We do not guarantee the accuracy, originality, or fitness for purpose of AI-generated content. You must review all generated content before publishing it. We are not liable for any claims arising from published AI-generated content, including copyright or defamation claims.

6. Third-party integrations

GrowDeck integrates with third-party services including Google Search Console, GitHub, Vercel, and Slack. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability or conduct of any third-party service.

When you connect Google Search Console or Google Analytics, we access your data under read-only scopes solely to provide SEO insights. You can revoke access at any time. Our use of Google data complies with the Google API Services User Data Policy.

7. Billing and subscriptions

Paid plans are billed monthly or annually via Stripe. By subscribing you authorise us to charge your payment method on a recurring basis. All fees are in USD and are non-refundable except where required by law or at our sole discretion.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain access until that date. We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

8. Free tier and trial

We may offer a free tier subject to usage limits. We reserve the right to modify or discontinue free-tier features at any time with reasonable notice. Abuse of the free tier (including creating multiple accounts) may result in account termination.

9. Intellectual property

GrowDeck, its logo, and all associated software are the property of PandaStack. Nothing in these Terms transfers any intellectual property rights to you. You may not use our trademarks or branding without written permission.

10. Service availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily restricts access and will provide notice where possible. We are not liable for losses caused by downtime or service interruptions.

11. Disclaimer of warranties

GrowDeck is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, that results will be accurate, or that using GrowDeck will improve your search rankings. SEO outcomes depend on many factors outside our control, including search engine algorithm changes.

12. Limitation of liability

To the fullest extent permitted by law, PandaStack and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of GrowDeck. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

13. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or create legal or technical risk for us or other users. On termination, your right to access GrowDeck ceases and we will delete your data as described in our Privacy Policy.

14. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved exclusively in the courts of Delaware.

15. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
